Community Bike Ride List December 06-13, 2014

This list is a major time commitment and it is my pleasure to put it together. All I ask in return for the list is that you remember I’m A REALTOR. If you have a relationship with another REALTOR, I love loyalty and respect those relationships. However, if not, or if you need a second opinion, Please keep me in mind. Many agents spend money advertising for new business, others make cold call or door knock. My business is based on referrals from past clients and friends. The less time I have to do traditional prospecting the more I can do for the cycling community. For example: this list.

Weekly Community Bike Ride List 11.15.14 – 11.21.14

There is a big change to the list this week. The Mountain Bike and Road Rides have been separated into different sections.

This Sunday there are 13 rides. One for everyone. The biggest challenge is deciding what bike and where to ride.

I’ll be at the El Grupo Fall Fondo. They still have room for a few more. I’m told that the swag bag is real nice. Add in a meal with Local beer from Iron Johns  and it’s going to make for a great day.

At the same time for the downhill Mountain Bikers TORCA has a poker ride on Mt. Lemmon and the prizes include a trip to Whistler. You ride, you get cards, best hand wins.

At the same time the Sandbox Showdown will be riding through the washes of Tucson on Fatbikes. This ride brings out the most colorful characters in the bike world.

At the same time Old Pueblo MTB will be at Sweetwater Preserve to congratulate the OV MTB athletes on an incredible year at the High School Mountain Bike season.

At the same time GABA has 5 rides. At the same time…

Many agents spend money advertising for new business, others sit open houses or cold call. My business is based on referrals from past clients and friends. The less time I have to do traditional prospecting the more I can do for the cycling community. For example: this list.

This list is provided as a courtesy. It is all public information that is put here to make life easier for those looking for a bike ride. Biking can be dangerous. People crash, they break bones, get bloody, have road rash, destroy bikes and even worse. The Damion Alexander Team is not responsible for any of these rides or anything that happens on these rides. By going on a bike ride you are choosing to make a choice in your life, one that will most likely lead to a healthy and happy life. However, if the unfortunate does happen, it was your choice to go and not Damion Alexander, The Damion Alexander Team or anyone else that made you do it.

The Community Bike Ride List 11.8.14-11-14.14

If you want to ensure you receive the ride list please email damion@damionalexander.com and put ride list in the subject. The format is a little different and easier to read in the email.

We have officially entered Bike Season for the masses. This week the list includes 24 unique rides.

This week I put some miles in the saddle house hunting with a client from Colorado.  I also gave them a tour of 50 year trail and the Urban Assault. If you have a friend moving this way who is a Cyclist, I am The Cycling Realtor and The Cyclists Realtor. Even if it is not looking at the homes on bikes, I’ll give them an introduction to what Tucson offers like no one else. Thanks in advance for all your real estate referrals.

Many agents spend money advertising for new business, others sit open houses or cold call. My business is based on referrals from past clients and friends. The less time I have to do traditional prospecting the more I can do for the cycling community. For example: this list.

Southern Arizona Community Bike Ride List for October 25- November 01

One of my goals of this list is to go on as many rides and give a review. Last week I was able to catch the Bicycle Ranch Sat Am shop ride as well as Living Street Alliances Kidical Mass Ride. What a great contradiction in what Tucson offers. A fast shop ride and slow cruise with kids.

Bicycle Ranch Summary and photos https://www.facebook.com/media/set/?set=a.10154767562795154.1073742148.228735085153&type=3

Kidical Mass Summary and Photoshttps://www.facebook.com/media/set/?set=a.10154746738710154.1073742145.228735085153&type=3

This week many rides have changed start times. I’ve tried to contact every ride leader, but it’s possible I missed one. If you see anything that needs changing please let me know. Also, as we get into the holiday season you might be looking for some additional motivation. I scoured the state for upcoming races.

The list now has over 30 reoccuring weekly rides, 20 rides this week, 8 upcoming events and over 20 races. There is a ride for everyone. So to quote Queen “Get on your bikes and ride”.

If you want to ensure you get this list and are not on the distribution list, E-mail Damion@DamionAlexander.com and put “ride list” in the subject. Also, feel free to use the same email to contact me about selling your house or helping you find a new one.

Many agents spend money advertising for new business, others sit open houses or cold call. My business is based on referrals from past clients and friends. The less time I have to do traditional prospecting the more I can do for the cycling community. For example: this list.

Rider Back! The etiquette and skills for passing.

After the first NICA high School race my son Samuel and I had a conversation that lasted a better part of the drive from Prescott back to Tucson.  He felt that he could have done better in the race, but that he was unable to pass riders.  He mentioned riders not yielding, weaving to prevent passing and riders off the bike on hills who made it impossible to ride past them.  Sam, who is a considerate young man, (yes, I might be biased in my opinion) wanted to know how to pass without being over aggressive.

I have never thought of the proper etiquette when it comes to race day even though I’ve been in many races.  The only “circuit” mountain bike race I’ve done is the 24 hours in the Old Pueblo.  Since I have been more in participation than race mode,  I’m always quick to relinquish the trail and patient to pass.  In longer races like the Tour of the White Mountains or The Whiskey I’ve found the start is thought out with enough road or jeep trail to allow the racers to find the spot they naturally belong in.  There just is not that much passing to be an issue.

When we returned home I asked this question on facebook  “I’m writing an article about passing etiquette during mountain bike races. Also, skills for passing.”  I also sent notes to Olympian Todd Wells, Krista Parks, Chloe Woodruff and  Coach Jason Tullous asking their opinion on the subject.  The following are the responses.

Todd Wells said : Hi Damion, Thanks for the note. Passing is a big problem. I can imagine in NICA races it is a really big issue with such large fields and different ranges in ability. I think one of the rules for a NICA course is it has to be a certain percentage of double track or fire road to facilitate passing. When ever there is a wide range of abilities passing is always an issue. I find it also difficult when I am racing on a course with multiple categories and they aren’t pulling riders so we don’t’ have a clear track. At a World Cup race riders will fight you tooth and nail for every position and there is no courtesy, if you can take the position you do and if you can avoid giving it up at any cost you do as well. In less competitive races there is a more civil way of doing things. Generally the slower rider yields to the faster rider. That is not to say they jump off the trail but they move slightly to the side to allow the faster rider to pass with the least amount of resistance to their own speed. Most times this works. There are always riders that won’t get out of the way and no matter how nicely you ask they just don’t get it. In those instances it up to the rider, they can take the position forcefully or wait until the trail opens up to pass. If the race is low key I will usually try to accommodate the slower rider and wait to pass. If it is a big race or a lot of prize money on the line I will take the position however I can.

I like to yell long before I get to the person so they have time to look for a spot to pull off.

Krista Parks said:  Hey Damion!  yep it’s a tough one… it has to come from the top that blocking is not allowed, not even for a second. If that instruction is not clear and enforced the faster rider will end up being the bad guy. I try to keep talking, “rider back”, “when you get a chance”, “on your left” (like it or not 🙂 ). Once I lost patience with a guy on a downhill after 5 minutes of trying to get by on the rolling section and said, “wow you are really slow”. that worked and I thanked him nicely as I passed. Obviously being nice is better than winning a race, you make way more friends that way. It is much easier to come up behind a new friend, use their name and ask for a pass than to make enemies then try to get them to let you by…

Jason Tullous said:  Simply, the rules are you must yield to the faster rider and that’s something the Conference director should bring to the Coaches attention and then on down to the riders. Most of the athletes are new to the sport and may not understand. Of course that typically does not solve the problem. You  will have to get more aggressive. This should mostly happen at the start. In the course pre ride, you have to determine how hard you will need to start to position yourself well. When you do get stuck behind a slower rider, first be patient and know the passing lanes. Save your energy to pass at that moment. Be sure to have your elbows out just in case. 🙂

If they will not move, you’ll need to be aggressive in looking for unique passing opportunities and pester the rider in front of you by continually asking to pass, stating the rules, rubbing their tire, etc… I think the best solution are the rules and your pre ride giving you a race strategy.

I followed up the question with Coach Tullous and asked for techniques to pass

“Be in an easier gear. This allows you to accelerate quicker. MTBers are typically bad at this but they are always faster for it. Practice cadence.”

The comments on Facebook are below.  Some were more joking, but I left them in as they were humorous.

Lindsey Cooper: So, yelling “move it, b*%&$!” isn’t correct?????

Ryan Floden:  Be sure to include common remarks such as yelling “STRAVA” or “On your left”

Kyle Akin: how about something for the trail corker that won’t get out of the way when you’re trying to win a race?

Damion Alexander:  Kyle, that is what I’m looking for. Thoughts on what is appropriate when you are timed and trying to do your best regardless of if that is for a podium finish or simply to finish in the best time you can. The reason I’m on this is after the first NICA race I had a long conversation with Sam about this

John Mertes: You should pass like people do during the 24 hour race, if there is no room, run the slower person into a bush…thats always fun, especially when you are the slow person.

Ma Fin: What Mertes said! Be sure to fire a snot rocket at them as you are passing and riding them into a cactus

Liane Ehrich: How about passers should be respectful of the person that they are passing? If you are passing you are strong enough to wait a few seconds for a safe place to pass and then take the bad line. Those being passed should look for a safe place and call out the direction they want the passer to go. If the place is too short, the passer waits until a longer line presents itself. Communication and respect should be two ways

Lauren Denise Gowan DeLillo:  I think you’re getting a lot of great material for a really funny book or at least a magazine article.

Julia Strange:  I admit to being one of those slower people and really can say it stinks when you are trying to get over but there are cactus (or rocks or a cliff) and the faster person passes anyway knocking you into the said cactus. I always get over as quickly as I can, even stepping off the trail if I have to … But I refuse to ride intentionally into a cholla so that someone can get 10 extra seconds of time

Daryll McKenzie: Lately there has been much of the load to pass put on the passer and very little on the person being passed. Racing on single track esp. with the wide bar craze makes for some sketchy passing. Too many times I hear at race meetings to be nice when passing and if you get out of line it’s a penalty or DQ. This has now sent the message to those being passed they have little responsibility and even empowers them to stay in the middle of the trail giving less room to pass. It takes both racers to give some to make it work. Just on our squad last race we had 3 sprint finishes for a podium placing that were decided by 1 second. Putting in hard work to distance a competitor and then giving it all back sitting behind a lapper is frustrating, watching a competitor ride away from you while you are stuck behind a lapper even more frustrating. MTB racing is one of those sports were you have to have a certain etiquette as you said Damion. The race rules and meetings should put as much emphasis on the person being passed (they really control the trail and pass situation)as they do the passer.

Richard Biocca: what we have here is not a passing problem. It is an entitlement issue. Daryll McKenzie is right on the money. I have the been passed and have passed and it is important that people respect each other. I always try to be nice and ask to passee and exchange some kind words when trying to perform a pass. I am also guilty of giving up on my relationship with said passee after they become difficult and get attitudes etc. I then hammer down and leave them behind and hope their day improves. When being passed I do my best to get the f out of the way cuz I know I am not the fastest out there and want to give the respect that we should all expect and not be a speedbump. I would never yell Strava either.

Ira Getraer: If you are going to get off your bike get clear of the trail and wait until no one is coming up behind you before you walk over the section you didn’t want to ride. After walking over the section look back and be sure no one is about to come off that section before you get back on.

Jimmy Bees: Rubbing is racing

Elliot DuMont: Better yet why don’t people just exercise kindness and common sense. If you’re passing someone chances are you are the better rider and should give the passee noticeable heads up before arriving on their wheel, the passee should wait for the closest time they can allow the passer to move over, the paser should move as far to the opposite end of the trail making the passee feel as safe as possible, then when the passer passes they say, “hey thanks, have a kick ass ride” or “hey thanks, you’re doing great!” AND LEAVE THEM IN THE DUST!

Jolly Rogers: I call passes on singletrack, bike paths, roadways and in the bar. The passing person also needs not to be yelling 1/8th of a mile back “rider up” but rather approach the individual and make verbal contact without yelling like a douchebag and expect the person to instantly clear for you. You are over taking or passing someone so you are are responsible for a safe pass on BOTH parties and some portions o f trail only allow for one rider at a time.

Elliot DuMont: I’ve always been impressed with the pros and how kind and patient they are on the trail. I got passed as most of you have by Karl Dekkker at 24 hop and he was ridiculously patient and kind.

Kit Plummer:  This is not a suggestion, but something from another sport with similar issues. In professional motocross/supercross – lappees are waved with a special flag by workers around the track, to let them know that leaders are coming up behind – and they are to give way. For NICA one of the issues is that four categories (and unlimited breadth in each) make up the ridership on the trails. The lap/distrance differentials allow the varsity and JV categories to finish the races with out having the interference. But, it creates an opportunity for all racers to “use” the lap/slower traffic. Just based on the experience of the V/JV versus Soph/Frosh groups I could see where it would be beneficial to both to separate the actual races. Until something changes, I believe respect between passer and passee must baseline whatever the protocol is.

Alex Paterson: I have been asked a few times when I am trying to pass someone what my hurry is….well it may not be a race to them but it is to me. I am a slow climber but I make up for it on the descents. I know when someone is behind me on a climb and I do my best to let them by ASAP. I will take the rough blown out route to get around people on the decent and yell on your left as I pass someone . In a race like the Whiskey passing is a real problem and congestion is a bigger problem.

Alex Paterson:  A race like the 24 Hours is another perfect example of passing making a huge difference to your overall time. If you have spend and xtra 2 to 5 minutes passing slower traffic each lap you can really loose some time. It may only seem like 10 seconds to the person being passed but it seems like time is standing still to the person doing the passing.

Alisa Payne Neave:  Shoving someone into a cholla – not good manners!  Someone with a loud voice (like a certain youth cycling coach) got my attention at 24HOP to move on over

Jimmy Bees:  Motorcross also uses hip check or posting them in a corner. A tailwhip seals the deal

Mike Perr< y Kit Plummer, et al. If the league continues to grow at its current rate, in 2015 we will likely split teams into D1 and D2 (based on size). When that occurs we’ll increase from two start waves to three (with each category separate by 5 minute start intervals): Girls – V / JV / S / F, Boys – S1 / S2 / F1 / F2 and Boys – Varsity / JV1 / JV2. This will help alleviate some of the congestion created by lapped riders, but it’ll also result in longer race days and the V and JV boys racing in hotter temperatures (even when we start the season in northern AZ).

Craig Boydell:  Having a bell makes a big difference. It can be hard to sound nice when you’re anaerobic but a bell always sounds polite. Plus, you can ding it a couple of times from a ways back and it gives the rider more notice, especially if there’s a big speed difference. Once you get closer you can then “I’ll pass if I can”. This combination seemed to work great at the 24, thanks to Bryan Little handing out bells to the Hosie Cows crew.

Ben Elias:  Craig Boydell has a good technical solution that is easy to implement and compliments respectful attitudes whilst passing or yielding

Richard Biocca: Another great idea is to only ride at night (my strategy) as your lights will give the passee proper warning. If you approach fast enough they will get scared and jump off course fearing an alien abduction

Kyle Akin:first of all, this is why there is a mad dash to the single track in MBAA races… Passing slows you down.. and that really sucks if you’re really suffering while leading a race with chasers behind you. Ideally, as you’re approaching a slower rider, you ring your bell, or let them know you’re coming and say “when you get a chance”.. be clear about the side you will be passing. The slower rider SHOULD give priority to the passer and if need be, pull off to the side and stop. You must be very careful not to clip the rider you’re passing.

Kyle Helmke: Passing is a game of ethics, If you’re caught by someone please yield ASAP

Krista Park:  I remember reading UCI cross-country rules stating that blocking was forbidden and could earn that rider a DQ. In enduro it is more obvious who is faster, if you are caught you are 30 seconds slower, almost everyone is amazing at getting out of the way. If not, other racers will talk about the one or two people who are known blockers. If you are caught, get over right away, if you can’t get over, ride off the trail and stop. I have done that twice; yes, it messed up my time but that’s how it works, over-taking riders have the right-of-way.

Damion Alexander : Great conversation. Thanks for all the comments. Mike Perry, Thanks for the picture of what might come as the league grows. At the same time, the question I’m trying to get at is not just about having to many riders on the course. It is about the riders in your category who are not willing to yield when they should. For example, on some of the wider sections with ample room to pass, athletes were weaving from side to side to prevent passing. Riders were also unable to make some of the climbs and were walking with their bikes in the middle of the path. With El Grupo and especially Samuel, we hammer over and over the importance of being respectful. I’d rather see no podiums and good kids than those who have a win at all cost attitude. I also get that these are young adults who are still trying to figure out what is right and wrong and sometimes those lines are hard to be clear of. Especially at times we see adults who set a bad example.

I do want to give you and John Shumaker props for having this conversation prior to the race. I hope that at the next coaches meeting you will bring it up again. Perhaps even mentioning some of the great points my friends have made here.

Mike Perry:  As we remind at every race, passing can define the day for both riders involved, positively or negatively. Besides the coaches meeting, it’s covered with each group in staging and I addressed it in two news letters leading up to Race #1, too. Whether racing or JRA, passing happens. Be a role model. https://madmimi.com/p/ca6645 https://madmimi.com/p/b40835

Mike Ingram: at 24 HOP I have noticed that the really fast people were excellent passers, they let you know, were polite, and passed when it made sense — then there were those clowns who did a dangerous pass/cut-off 20 feet before the doubletrack and who then proceeded to slow down going up the bloody hill ( fighting for number 1991 vs 1992 nd place I guess )

Patrick Fraher:  The NICA & Arizona models are about sportsmanship on both parties accounts. I advise my kids to be safe whether passing or being passed. If there is no reasonable place to pull over then the passer will have to wait. If someone rams them, grabs their bars or causes injury to them, then we as coaches need to evaluate what we are teaching & correct it. Not every kid out there has racing experience going into these events & I really appreciate the league doing their best to emphasize safety. I don’t want my freshman girl getting run off the trail & quitting the team because of the unsportsmanlike attitude of a few. Nobody is earning a check yet & I’d rather they kept cycling the rest of their life instead of hating it. It is an ALL INCLUSIVE league, not just for the elite racer

Kristin Élise Hillman Fukuchi: I don’t know the rules about which side to pass on but a rider came up on me during a Mtn bike race and asked to pass so I pulled left because it was the safest spot for my riding ability and then he got mad that I didn’t pull right (off a pretty good cliff mind you). It’s not a road race, right? At least I pulled over and was trying to be nice. He still managed to get around but I think he lost 2 seconds of time.

Dave Sewell:  My experiences at races have almost always been positive, while passing, or more often being passed. Most people are kind and patient. Communication is the key.

Intentionally blocking a faster rider should be grounds for a flogging, it is unsportsmanlike childish. Being an ass when you are passing deserves the same treatment. Passing and being passed is something that should be coached, and practiced (on both ends) by racers. Faster riders cannot expect you to give up the good line if you are a passee, it is up to them to take the rough ride around line. But like Nicole said, there could be times where you need to just pull over and let the by. There are exceptions to every rule. Anyone off their bike or stopped should be off the good line, and like someone said above, make sure it is clear before trying to get back onto it.

Mark Flint:  course design/modification can also help. I just finished designing a new course, and we’re going to put in passing lanes wherever it’s feasible (i.e. whenever the side slope grade is low enough to make a wider track or a passing lane. The start has about a quarter mile of uphill that is wide, gradually tapering to singletrack. But as others have said, basic rules of courtesy and respect should (unfortunately don’t always) eliminate negative experiences.

Donald Lewis: It’s Mt Biking, there is no etiquette!

If you read through all of this, what do you think the take away is?  If you were a race director, how would you structure your rules?

Meeting At UAMC Hospital room with Deputy Art Gutierrez

Lorena Evan, Brendan Lyons, Rep. Ethan Orr and Senator Steve Farley meeting with Deputy Gutierrez to discuss bike safety laws.
Lorena Evans, Brendan Lyons, Rep. Ethan Orr and Senator Steve Farley meeting with Deputy Gutierrez to discuss bike safety laws.

50 weeks ago I went to UAMC- Diamonds Children center to see Brendan Lyons after he was in a collision on his bike while riding his bike on East Sunrise.   A few days later I orchestrated the media and a meeting in Brendan’s hospital room  with Senator Steve Farley and Representative Ethan Orr to discuss laws for cyclist safety.  As a result, we introduced 4 bills in the state legislature last year.  Unfortunately, not even one made it out of committee. Brendan and I have spent hundreds of hours in the past year trying to find ways to make cycling safer. Yesterday, El Tour de Tucson announced that Brendan and his girlfriend, Lorena Evans, who was also in the collision, are the honoree for the 2014 El Tour De Tucson.  Wednesday night, at 9:30 Brendan called me and told me that he had met with Office Art Gutierrez, who was struck from behind this week and at UAMC.  After burning the midnight oil, Thursday morning, life came full circle and I found myself at UAMC with the media, Rep Orr, Senator Farley, Brendan and Lorena.  This time in the hospital room we also had Pima County Sherriff Deputy Art Gutierrez,  his daughter, Cynthia,  girlfriend, Delia, as well as some of the Sherriff Department brass.

Brendan asked the Deputy if he would like his story shared.  Like so many people who serve our country, Art was willing to put his personal suffering aside if it might help save someone else.

His daughter Cynthia and son Alex are also cyclist.  They recently rode in El Tour De Mesa as a family and finished in about 3 and a half hours.  Cynthia was the first member of the family to get into cycling  7 years ago.  Art got on the bike because of her 5 years ago.  She recalled with a smile that in the first El Tour she rode with her Dad that it took them 8 hours.  In 2013 they had shaved over an hour and a half off that time.  Alex got on the bike last year and this year they were expecting to be even faster.  Delia also caught the bike fever and recently bought a bicycle.

The details of the accident are only too familiar.  A driver came up behind the Deputy and struck his Bike from Behind.  Statistically, this type of collision is the most common to result in a death.  All things considered, it looks as if Deputy Gutierrez  got off with only “minor” injuries ( If spending  days in the hospital and not knowing when you will be released are minor) He has no recollection of the actual collision and woke up in the hospital.

The following is from the interviews Deputy Gutierrez:

Deputy Gutierrez, much like Brendan after his accident talked a lot about how safety is every ones responsibility.  Both  the cyclist and the motorist.

He said it was “surprising” waking up at UAMC, he had no clue what had happened.

He is “hurting, sore, his body hurts, feeling down,  but feels fortunate that he is here.  Fortunate to be alive.  To know he will recover.  Thankful for his family and his co-workers. “

He has no broken bones, but possibly had a small stroke that has led to a lack of feeling on the right side of his body.  He has road rash all over his body.

When asked if he was going to get back on his bike he replied “as soon as I can,  It is something I really enjoy, I want to go back”.

Asked about the accident and who was at fault and how the Sherriff Department would investigate he said that the Dept.  will do a full investigation but that he has no recollection of what happened. A full investigation will be conducted to determine who was at fault.  He stated again that sometimes it is the cyclist, but that the investigation will determine the fault.

The driver did stick around after the collision.

The collision was on Tanque Verde between Houghton and Tanque Verde Loop.  He was on his way to ride up Mt. Lemmon to mile 4 or 5.  He had only gone about 3 miles on his ride.

When asked about stricter laws for motorist he said “there is a lot of impatience with todays drivers and not just with cyclist but with pedestrians … and with social media, people distracted constantly talking on the phone, texting, doing whatever they do… I see it every day as a patrol officer, I see it every day, but I also see the bikes making the same mistakes being dangerous and the pedestrians J walking and can’t wait,… we need to be more patient.  What the drivers need to understand is they are in a 4000 pound piece of moving machinery, if you hit a person they lose.”

He would like to see something done for the texting and the cell phone use for drivers.  Personally he finds it annoying and sees it all the time.  “Driving is a privilege, not a right.”

One thing that was very clear during the interview was how level headed and patient he is.  He understands that the solution is patients and understanding with efforts from everyone who uses the roads.  Perhaps if everyone can have a mindset like that, we could truly create an environment that is safer for everyone.  I’m so thankful that Deputy Art Gutierrez will make a full recovery and hope his spirit and ideas will spread throughout the Pima County Sherriff Dept.

The Shootout Stopped And Ticketed

Mass tickets were issued on May 10, 2014 on the Shootout for failure to stop at a stop sign.   Many riders said they did come to a complete stop, but the Sherriff ticketed the entire group.  It is a $187 ticket.   Fortunately, I opted for the Miles Ahead Shop ride this morning and missed it, but made the following post on Facebook.

“I heard the Shootout was stopped for running a stop sign with multiple tickets. Curious if you got one?

The post attracted so much attention that I have been pondering the incident all afternoon.

The entire dialogue is below, but I had a few thoughts of my own.

Our legal system is flawed when it allows people to be ticketed when they did nothing wrong.  Many riders today said they came to a complete stop, one even put a foot down, and they still received citations.  They will have the opportunity to argue their case in court, but that is time and aggravation that is not merited when you did nothing wrong.   Others blew through the sign and were rightfully ticketed.

I have ridden the shootout.  I have seen red lights run, the centerline crossed and riders taking the entire road 5 across.  I’ve also seen professionals, tourists and business owners who call Tucson home (or visit)  because of the cycling.  The shootout has been mentioned by these people many times, it receives national attention as one of the best weekly group rides in the country.  This is one of Tucson’s Treasures.   That translates to more money in Pima County, leads to more jobs and creates a better community for all of us. We need to make sure we protect all attractions that make Southern Arizona so desirable.

Is this the way the shootout has been, is and will be and is just a part of a 150 person group ride? How many citations would be needed to make people change their behavior?  Who is going to take the role of authority and lay down the rules?

One point that was not mentioned is the Idaho Stop.  It is a law that allows cyclist to treat stop signs as yield signs.  From a cyclist prospective, they are great.  I’ll write another blog about them soon.

The following is the conversation about the incident.

Devon Balet Good! They should be ticketed

Michelle Lowenthal Helmke I was lucky to get a flat just before Duval mine Rd  prob 50 tickets given

Kim Bourn Yes, about 60 riders in Green Valley.

Kim Bourn A few riders didn’t stop, others did and entire group got individual tickets.

Linnea Herbertson I got a ticket and I even stopped and put my foot down 🙁

Damion Alexander Thanks Linnea. Kim, did Don get a ticket as well? I’m just trying to figure out how an entire group can be ticketed when most people do stop. It seems like all the tickets should be thrown out. I do agree with Devon on one level, if we are not obeying the laws, we deserve tickets( but perhaps not on a a stop sign in the middle of nowhere where you can see traffic in both directions for some distance)

Kim Bourn Yes, Don got a ticket and did stop.

Linnea Herbertson The cop said he had it all on video, so I’m hoping it shows me stopping because I don’t feel like paying 187 for something I didn’t do! However, it is difficult to differentiate people when we all are wearing kits and and such.

Denise Schuldt Amos I hope anyone who got the ticket and stopped fights it! I also hope the ones that didn’t learned their lesson and pay up. on another note it seems the shoot out is being targeted? I haven’t been on the ride so I don’t know if it’s warranted, but I hate when law enforcement entities decide to do targeted enforcements like that. == Seems to be something that should be discussed at the next BAC meeting.

Tyler Stites Seriously Devon?

Tyler ShafferTyler Shaffer I have been on the ride and there is a moderate level of sensible behavior, but there are also moments of mob mentality guided entitlement. I have been on a ride where a sheriff’s deputy ran riders off the road too. The shootout makes itself a target by the nature of the ride and there will probably always be a push and pull between riders and drivers/law enforcement. For those that break the law because everyone else around you is doing it’s silly to complain for getting nailed for it, and it is also silly to think you will be fine and above getting in trouble if you are riding with people that break the law.

Kevin Harsley I got one & I was 2nd place telling everyone to stop & watch out for them. I did a track stand (which is legal) next to the guy who put his foot down & I got a ticke

Damion Alexander Any lawyers reading this? Is there a group defense? I think Tyler Shaffer made a great point about “”getting in trouble if you are riding with people that break the law”, but last time I checked in America, it was innocent until proven guilty. Of course, you need to prove the innocence and if the video is not conclusive, how can you argue you did stop or how can the man say you didn’t? Kurt Kroese, Scott Biaggi?

Kevin Harsley I certainly did not see any cops in front of the group which leads us to think the video was shot from behind. Which will be impossible to pick out faces in the video. So seems like 1 of 2 things will happen. 1. Judge says I can’t see your face or anyone’s face so everyone who fights it gets off or 2. for the same reason no one gets off and we’re $187 lighter!

Jimmy Bees Civil traffic is not innocent until proven guilty. The legal definitions us more likely than not. As far as targeted enforcement it is don’t to address a problem and anyone that rides the shootout, and I do, can clearly see the disregard for traffic law by the riders. We have brought this on ourselves. How about we work in organizing a few other group rides on Sat to include the east and nw sides of town so the group is not as big and then the real problem can be solved. Bitching about the cited does not solve anything and the problem we started continues.

Chris Cunningham You are innocent until proven guilty. If you get a ticket, and pay it, then you have admitted guilt or you are at least not contesting it. You can go fight it and be proven innocent or guilty in a court of law.

Jimmy Bees  Chris you need to learn the law. Guilt and innocent is criminal law. Civil is responsible or not responsible. Huge difference. Criminal is beyond a reasonable doubt. Civil is more likely than not. 51%vs49%. The officer is considered an independent witness. The person with the cite has to prove they didn’t do it after the officer establishes a few things. Either he saw it or can establish it happened. The court has jurisdiction over where it occurred and who he cited.

Jimmy Bees In addition pima county has a bicycle diversion program like traffic school. Complete it and cite is dismissed

Ken Montaney Strava files should be able to prove whether you stopped or not. And bicycle diversion is a free alternative to paying the fine. Sounds like the officer overstepped his bounds but at the same time sheriff’s have been on the shootout the past 2 months. People should have seen this coming and anyone who did run the stop sign and ruined it for everyone else is an arrogant asshole

Ken Montaney Ps. I got a ticket myself for being an “arrogant asshole” riding around town a couple weeks ago.

Lynn Orchard Everyone. The sheriff wants us to go in and show on his video that we did stop. That is backwards… the burden of proof is on the sheriff. Everyone who was cited must contest and no one should volunteer to ID themselves on his tape. Make him match you in your suit and tie to the blurry sunglass wearing mass of lycra. Also… this was targeted and so it had some direction from some higher ups. A coordinated letter writing campaign to Mr. Huckelberry, the Pima County Administrator, and Sheriff Dupnik is in order. Or we could wring our hands and moan and let them target us each Saturday. Be respectful…Mr. Huckelberry is a HUGE cycling advocate and has done tons of good for our community. His contact info is: County Administrator’s Office, 130 W. Congress St., 10th Fl

Lynn Orchard Ken Montaney that one actually sounds deserved. 😉

Ira Getraer I would fight it and question the cop about pointing out you specifically in the video. He can’t claim to have kept track of every member of that large of a group at the same time.

Does anyone have GoPro footage from a riders perspective? That would atleast prove some people stopped and give a judge reason to doubt the officer knows every single person didn’t stop.

In other news no mountain bikers were ticketed en masse today so maybe try riding where traffic laws don’t apply.

Christine Jeffrey We are being targeted because a lot of the group chooses to disregard traffic laws. There were riders across the center line for most of the ride this morning and from my point of view, the last rider through the stop sign, most of the group didn’t stop and a good number of those that did stop were on the opposite side of the yellow!! Hello!!! Were are all the comments about how we as cyclists should obey traffic laws, instead of complaining about being targeted.

Christine Jeffrey And there was definitely a car right at the stop light taking video.

Lynn Orchard Christine, I was on the pointy end of the ride but I didn’t see anyone over the center line at all… And we were mostly two by two the whole ride, or single file when it ramped up. The cop started trailing us in town and was just looking for anythi…See More

Ira Getraer So you’re saying the same group of cyclists rides the same route at the same time every Saturday, and a lot of them run a stop sign, and you’re upset that law enforcement targeted this behavior to put a stop to it?

Lynn Orchard Yep.

Christine Jeffrey There were definitely people across the line and for the past three and a half years of living here and riding the shootout the majority of the riders roll that stop sign. Of course the cops are going to target it if people are always breaking the law there. They would do the same on a corner if every car was refusing to stop.

Lynn Orchard Christine… did you get a ticket?

Christine Jeffrey No, I new the cop was there, was there last week hiding with a video for the main shootout. Dropped back a couple hundreds yards from the group before Duval Mine road, did a complete stop at the sign, and wasn’t asked to stop by cops so kept riding.

Lisa Ribes Roberts Just FYI guys, legally it is every rider’s responsibility to stop at a stop sign. Two by two if necessary, but a few stopping or pausing and yelling ‘clear’ won’t cut it. I teach the diversion classes for Pima County and that is just about rule #1. Right after riding on the correct side of the road. Please don’t bother Chuck Huckleberry with this; he has more important things to do!

Lynn Orchard Yes bother. Bother bother bother!

Jorgiana Jake Those “roll through” folks give a bad name to the rest of us who follow the rules. I’ve never hesitated to let the rule breakers know that after a ride. If you obey stops in a car, so the same on your bike. If you don’t obey stops (car or bike) the ticket is deserved.

Jon Roberts All, years ago I spear headed a meeting with all local law enforcement, county attorney and governors office to clarify the interpretation of the bicycle statutes. We made great headway for the cycling community and have had relative peace for

Jon Roberts Years. Running a stop sign is not up for interpretation and will setback relations with law enforcement. I hope everyone takes a breath and deals with this properly. The sheriff in GV has a long and rocky history with cyclist but the court is fair. My two cents!

Lynn Orchard The issue is that the police gave tickets to everyone guilty or not….. and that they are there every week hounding the ride. If a cop followed you in you car for 60 miles week after week and was bent on giving you a ticket… eventually he would find a reason. That was what happened today.

Lynn Orchard Christine, I would be interested in hearing your tune if they decided to pull everyone over while you were still in the group. What if next Saturday morning they nab the entire ride because someone crosses the yellow and you are there in the bunch and end up with a ticket.

Jon Roberts Lynn, I was one of the 46 ticketed at the top of freeman during the law enforcement sting operation years ago due to many months of the wed ride breaking rules. I joined the group from my house 2 miles before the stop, breaking no rules and still was cited. So yes it happens out of frustration because the cops are responding to complaints and are forced act. We need to be better Stewards of the road

Ron Buotte I see the attitudes at the Saturday World Championships haven’t changed.

Kyle Van Renterghem I also received a ticket and what really upsets me is that any government entity can fine and punish people who did no wrong. I was towards the front and yes I’m sure people further back probably rolled through the stop sign which is illegal, enough said. However, according to the very knowledgeable Jimmy Bees it is the responsibility of the accused to prove their innocence simply because it is defined as a civil infraction (one that still costs a minimum wage earner 24 hours worth of pay). It very worrying that any government entity can cite/fine an entire group of people and and then say that you are responsible for for proving unequivocally that you did not commit the crime. Especially when there is no way to defend yourself from this sort of accusation short of video taping every action you ever make. That is too much power for any agency. Guilt by association is not an acceptable policy.

Todd Mion Here we go again.

Devon Balet Tyler StitesTyler yes, seriously. I am a cyclist too. Breaking a law is breaking a law. Being on a bike doesn’t make you above simple laws like a stop sign

Damion Alexander Thanks Devon. In a nutshell, that is what this comes down to. It’s the law. Break the law, get a citation. Hang out with people breaking the law, you might get thrown in with that group, even if you are innocent. How many citations would be needed to make people change their behavior? Who is going to take the role of authority and lay down the rules? Is their a figure in the community who riders would listen to?

Bike Safety Bills Introduced in Arizona today

Many months ago I called on Arizona House of Rep Ethan Orr and Senator Steve Farley to talk about bike safety laws.  Not long after our first meeting, my good friend and bike safety advocate, Brendan Lyons and his girlfriend Lorena Evans were struck by a car while riding.  What was a tragic day for them has resulted in a passion that has seen 3 bills introduced on bike safety.  This is a great step, but the battle has only just begun.  We need YOU to contact you State legislators and show your support for these laws.  Below is a letter from Brendan and 3 letters you can send, one for each bill.  We have spends hundreds of hours to get it this far, all you need to do is take a few minutes and contact your Representative and Senator

As a Professional, career Firefighter and EMS provider who happens to be an avid cyclist, I recognize that PUBLIC SAFETY is much more than responding to emergency calls. This resides in awareness and educating the public on everyday hazards, moreover encouraging legislation, which could help facilitate the need to prevent such hazards from taking someone’s life.

In early October, I went for a ride with my girlfriend to celebrate her birthday. Unfortunately, an inattentive motorist struck us both from behind. Still in recovery, uncertain of my return to the Fire Department, I am utilizing my “near-fatal” incident to awaken the users of our public byways. I invite and encourage you to take a moment to read this article I wrote, regarding the very incident that nearly took my life. Here is another article, recently released disclosing what I am doing to better not only Tucson, but the entire state of Arizona.

***Attached you will also find two pre-written letters which you may personalize

Dear Representative / Senator [Last Name]:

As a member of (YOUR BUSINESS/AFFILIATION), I write asking for your support in H.B. 2622, the bill is to protect vulnerable users from drivers operating vehicles in a reckless/malicious manner and a presumption of liability on the part of the motorist if a collision occurs.

Representative Orr (H.B. 2376) is the primary sponsor of this bill, which is awaiting consideration from the State of Arizona Sub-Committees.

A “Vulnerable User of a Public Way” includes any LAW ENFORCEMENT OFFICER, EMERGENCY RESPONDER, or a WORKER in a State Highway Work Zone. Also includes Pedestrians, or Person(s) Operating any of the Following on a Public Way, Crosswalk or Shoulder of the Highway: A Farm tractor, skateboard, roller skates, in-line skates, scooter, wheelchair, and a bicycle.

We hope to humanize everyone who utilizes our public byways with your support of H.B. 2622. Why not support a law that will protect those (First-Responders) who protect us? To foster such protection of vulnerable users will encourage tourism, inviting comfort to those who travel here for recreation and enjoyment of life. Nobody wants to be struck by a vehicle and no driver wants to crash into anyone, let alone kill them.

Again, thank you for your consideration and support of H.B. 2622. Please do not hesitate to contact me if you have any questions or if I can be of assistance.

Sincerely,

Dear Representative / Senator [Last Name]:

As a member of (YOUR BUSINESS/AFFILIATION), I write asking for your support in S.B. 1147, the bill is to prohibit the use of text messaging, which diverts a person’s attention away from the primary task of driving. Texting while driving is a growing trend, and a national epidemic, quickly becoming one of the nation’s top killers.

Senator Farley (S.B.1147) and Representative Orr (H.B. 2376) are sponsors of these bills. This is awaiting consideration from the State Transportation Committee.

Texting while driving:

  • Causes nearly 25% of all accidents, 1.6 million per year –National Safety Council
  • Is about 6 times more likely to cause an accident than driving intoxicated
  • Is the same as driving blind for 5 seconds at a time- VA. Tech Transportation

As you may know, research like this has driven 47 states to pass legislation banning texting/driving. National cell phone carriers, such as AT&T are campaigning, “Texting & Driving, It Can Wait”. As technological distraction increases, Arizona has an opportunity to make a stand, decreasing the number of collisions on our roads.

Your bipartisan support for S.B. 1147 and/or H.B. 2376 shows your compassion to preserve the Life of your citizens. Please do not hesitate to contact me if you have any questions or if I can be of assistance.

Honorable Representative Karen Fann

Arizona House of Representatives

Capitol Complex

Phoenix, AZ 85007-2890

Dear Representative Fann:

As a member of (YOUR BUSINESS/AFFILIATION), I write to ask your support for H.B. 2545, the bill is to protect the safety of cyclists while riding on a public roadway, shoulder, or bicycle path.

This bill is sponsored by Representative Orr and is awaiting consideration in the State Transportation Committee.

This bill is important because it will provide a broadening of protection to cyclists on the shoulder of a road even if there is no bike lane and will require debris to be cleaned from bike lanes after accidents. As you may know, cyclists ride to commute, for better health, and simply to enjoy life on a daily basis. Our local, city, and state leaders have made significant strides in making it safer, investing millions of dollars to cycling-safe infrastructure. Why not enact laws that will help keep your constituents safe?

The economic impact that cycling brings to this state is substantial.  Arizona is highly ranked as one of our Nation’s Top Cycling Meccas; recognized by “Outside Magazine” with Tucson being the #1 Cycling Town in the United States. The League of American Bicyclists ranks Arizona as the 10th Bicycle Friendly State, hosting 9 Bicycle Friendly Communities, 11 Bicycle Friendly Businesses, and 2 Bicycle Friendly Universities. Your bipartisan support for H.B. 2545 and bills to protect cyclists only show your compassion to preserve the Life of your citizens. Please do not hesitate to contact me if you have any questions or if I can be of assistance.

Can’t we all just get along

In the past few weeks I have seen a rising tension between cyclist, pedestrians and cars.  This is both on roads and trails.  This weekend I witnessed my first collision when a car took a left turn in front of a cyclist.  Last week I found a pile of nails on an urban trail.  A cyclist who leads a Tuesday morning ride called and told me they are having more flats from tacks and have even been picking them up on the decent.  The Shootout was pulled over twice by the Sherriff Dept. this past Saturday.

This is nothing new.  As more and more users are taking advantage of our incredible climate and infrastructure it is not surprising that some tension exists.  On the trails this has been going on for generations between equestrian users, and hikers.  Mountain bikes have added a new dimension to the mix.  Bikes fly down trails, around blind corners, buzz hikers, and spook horses.  Riders chasing Strava KOM’s and personal bests segments are disrespectful and not willing to slow down.  An overall feeling of entitlement from everyone seems to be the norm.  On the roads group rides are acting like they are the only people on the road and are riding 4 across.   People are urinating on the side of the road without making any effort to find a bush.  Cars ignore the 3 foot laws, speed pass riders and make sudden right turns, throw things out the window, lean heavy on the horn, scream, and even mace cyclists( yep, it happened to me).

As new trails spring up or are getting more traffic home owners are becoming angered by the actions of those using the trails that cut close to their homes.   I’ve been confronted by owners on washes where I have been riding for years telling me not to ride there.  I try and have engaging and polite conversation and ask what their objection is.  I’ve heard “It will bring a bad group of people”, “The bikes and hikers will trash the wash”, “It is not our property, but It is private property”, and my favorite “you will get bite by a rattlesnake and sue us”.  I could go on and on about how most hikers and bikers leave the trails better than they find them.  From a crime prospective, I think bikes are a good thing.  We come down trails at speeds that thieves don’t like.  We are the neighborhood watch program.

As with everything, we as trail and road users need to take responsibility for our actions and do what we can to improve relationships.   Use your common sense.  Give people extra room when passing.  Let them know you are there with a bell or say “rider back” and “passing on your left”.  Slow down and say hello.  If you really need to go to the bathroom, hide behind a tree.  If you are hiking in a group don’t take up the entire path.  Move over when someone says they are passing.  Turn the music down so you can hear the outside world.  Pay attention when you are behind the wheel to what bikes do that piss you off and don’t do that when you ride.  Go for a walk on the trails you ride so you can understand what it’s like when a bike is passing and darts in front of you at speed and then quickly veers back into the other lane.  If you are a walker, get on a bike and see how walkers blocking the road can stop your rhythm.  Basically, walk (or ride) a mile in others shoes so you can understand we all have the potential to make improvements.

always show courtesy when passing path users

If we all take the time to be more patient and sympathetic we can make this a great community for everyone.  I look forward to seeing you on the trails and remember, Please say rider back when you pass me.
